After a contentious four-minute argument, Municipal Court judge Stephen F. Belden decided he had had just about enough of defendant Harry Brown's mouth. So he had his bailiff shut it with duct tape.Belden said he first heard of this unconventional way of maintaining order in the court at a training session, but hadn't had to resort to it during his previous 12 years on the bench.
For his part, Brown, who was silenced during a pretrial hearing on charges of shoplifting and fighting with Wal-Mart security guards, claims that he lost some mustache hairs during the duct tape's painful removal, and is thinking of filing a complaint with the Ohio Supreme Court.
This may be an uphill battle for Brown, for despite our founding fathers' clear love of justice and facial hair, the Sixth Amendment contains no provision for a defendant's right to an intact mustache.

The judge should have acted in a civil and professional manner by having the defendant removed from the court room and taken back to his cell.
My wife talks too much (sometimes) and I would be before the court if I taped her mouth shut! The judge should be offically rebuked, censured. If the judge is not punished, I can see teachers, husbands, wives (yes, some are big enough to control their husbands!)and maybe even employers resort to the same tactic to silence annoying people. Could the jailer duct tape a prisoner's mouth? Should they use super glue the next time? The answer is, "not in a civilized country."

we the guy should count himself lucky that the judge just duct taped him instead of contempt of court which is a hefty fine and about a week in jail oh and by the way George BUsh doesnt live in Crawford, TX anymore he lives in Dallas.

Supporting the judge's behavior can become a very slippery slope. Yes, we can all say the "criminal" deserved it but once a civil society tolerates the abuse of its citizens it becomes no better than the criminals it wishes to prosecute.

more judges like this one would cut down on a lot of the foolishness that we put up with. if you act up, you get the tape. good for him. for you bleeding hearts, maybe you should be used to 'house' some of these animals.

When a Judge tells someone in court to behave, he's not asking the defendant, he's TELLING the defendant to shut up. Lack of respect, coming from how this snot-nosed kid was raised, is the real issue here. You do NOT get to argue with a Judge if he tells you be quiet. In court, the Judge IS the final authority and what he/ she says IS final. Peroid. End of discussion. YOU GO Judge... Duct tape... that's funny and effective.

What ever happened to holding him in contempt of court? I dont agree that what the judge did, there were other ways to handle it. Let him sit in a jail cell until he decides to shut his trap and let the judge talk.

James, put a sock in it. The man needed to be quiet and pay attention in court. If I were a judge, I would do way more than put duct tape on his mouth. He needs to show some respect in court to the judge and to the others in the courtroom.

What happened to contempt of court??? Judges find people in contempt of court and they are removed. That is the procedure. If a parent or teacher put duct tape over someone's mouth, it would be considered abusive and they would be charged. I guess judges are above the law and not using procedures already inplace?!

Duct tape is not what you use in that situation.
Some people are allergic to the glue and could have a severe reaction. A person who has asthma or cannot
breathe through his/her nose could be in danger of
suffocation. There is a ball and gag that is made for this application that is safe to use. The "trainers" in these judge seminars should rethink.

Hilarious!
Besides, criminal defendants don't have all their constitutional rights. For example, most are held in jail before trial unless they pay bond, and thus lose their most obvious rights to freedom. Plus, this man was in contempt, disrupting the process. He gets some duct tape as punishment, better than more jail time!
