It might sound like something out of a sub-par episode of "Mad TV," but police in Lancaster, Penn., actually arrested an Amish man for drunken driving behind the reins of his horse and buggy. And we've got the documents to prove it. According to a press release provided by the East Lampeter Police Department, police received a call from an off-duty Quarryville Boro police officer on Sunday regarding a possible "DUI driver in a Horse and Buggy."
The officer suspected the driver might have been drunk since the vehicle was "straddling the center line of the roadway."
A passenger of the officer's vehicle got out of the car, approached the buggy on foot and noticed the driver, identified as 22-year-old Elmer Stolzfoos Fisher of Paradise, Penn., slumped over and asleep. He also had a "strong odor of an alcoholic beverage on his breath and bloodshot, watery eyes." A breath test revealed a blood-alcohol level of .18 percent.
Police arrested Fisher for driving (shouldn't that be riding?) under the influence and filed a criminal complaint with the Lancaster County Magistrate's Office.
Asylum has obtained the official criminal DUI complaint filed with the Magistrate that lists the "make" of the vehicle as a "horse & buggy."

So he was not driving, but sleeping. In other words he was an obstcle in the road. What would Andy Griffth do in Mayberry. How about escorting him home and a small lecture rather than throwing him in jail, fining him up to $10,000, charging him court costs, attorney fees, probation, inpounding his hourse and buggy, removing his right to drive, and humilling the hell out of him.

I lived near Amish country for awhile, and about 10 yrs ago there was actually a child who died from a horse and buggy accident. 2 boys were racing each other in their horse and buggys and they ran over a child and killed her. So the cop did the right thing - just because it was a horse and not a car it doesn't mean it isn't dangerous for the other people on the road. What if a car was driving down the road and had to swerve in order to avoid the drunk guy in his buggy? Would you feel the same way?>

My grandfather was a farmer and at the age of 82, a police officer pulled him over because he was going too slow. Grandpa did'nt have a driving license because in 1960's most farmers didn't have a license. He lived in the country and only drove to the local store which was a half mile away. Well, he never drove a car again. He drove his tractor to town!!!

Talk about "Hoss, you ain't gonna believe this!" Although I have heard of (and encountered) stranger ones...like a guy who got arrested for operating his motorized wheelchair under the influence (yes, that actually happened!).
And Whoa Nelly, the Amish aren't just in Pennsylvania anymore. They're in Ohio, Maryland, Iowa, Minnesota, Kansas, and several other Midwest states as well. Still, I can just see the raised eyebrows of the other officers upon seeing THAT report...how often do you see something like "horse and buggy" under vehicle make?

Penn statute the key here is any vehicle
DUI-Driving under the influence—Driving, operating or being in actual physical control of the movement of any vehicle while under the influence of alcohol or any controlled substance to a degree which renders the person incapable of safe driving as prohibited and punishable under 75 Pa.C.S. § § 3802, 3803 and 3804 (relating to driving under influence of alcohol or controlled substance; grading; and penalties).

At least he wasn't on his cellphone texting or talking as most of you do while driving, which should be considerer Driving while impaired and carry the same penalties. As for paying taxes, they do pay property taxes. As for the horse, he would have gotten the man home if he wasn't hit by one of the afore mentioned texters,

If this guy had not been stopped he could have caused some innocent people or himself to get killed. I think the police done what was right.

Al, according to the Penn statute he's innocent. If he was sleeping as stated,he couldn't have been driving, operating, or in actual physical control of the movement of the vehicle. Being asleep just means he was riding in the buggy. The horse crossed the center line, charge it with, oh let's say , reckless walking.

Lancaster County is in Pennsylvania, NOT Ohio! How many horse and buggys do you SEE in Ohio? I thought that was pretty much a Penn. Dutch country Amish thing. Sheesh.
Gee Nelly, You don;t get out of PA much do you. We have just as many Amish with Horse and buggy as you do over in PA. Come over and see sometime Tusc, Holmes and Wayne and ADAMs and Scioto counties, just to name a few. So Sheesh you might want to get your facts and all in line before you show every one what kind of Shlemiel you are

Some cops just want to make Oboma seem correct after he called them STUPID. The watch commander should take this cop to the side and have a little chat with him on how he made all of his department look STUPID..........

Looks like the statutes simply refer to operating any "Vehicle", not just a "Motorized Vehicle". I think the Amish guy is screwed.
