Nov 19th 2010 1:08PM There seems to be a fundamental misunderstanding on the board - or at least by "Thinkbeforeyouspeak"...

Comments which are welcomed or do not cause the recipient to fee offended when said, so matter how lewd, do not fit the definition of harassment. An essential element of harassment is the behavior was not welcome or was offensive TO THE RECIPIENT. It doesn't matter if everyone else in the world would have found the behavior offensive if the recipient didn't then it's not harassing to them and thus, not harassment. This doesn't mean a company couldn't or wouldn't punish someone under the guise of "sexual harassment" or even fire them for it. What this means is that courts require evidence of conduct being unwelcome at the time it was done - not afterward when there's something to be gained by being offended. Hell, of course she's offended now, her complaint depends on it.

What this means, is that whatever was said to this woman, if it wasn't offensive to HER WHEN IT WAS SAID then then it wasn't (public law) harassment. She can't come back after being fired and say oh, by the way, I was harassed even though I brought the behavior on and welcomed it myself now I've lost my job let's reassess things. Perhaps it worked for her to flaunt her boobs then and she'd trying to make it work for her to call their reaction to her behavior harassment now she's lost her job. Basic opportunistic behavior IF that's what she'd doing - the court will decide.

It's a grown up world and we're all discriminated against for something or other.

Nov 18th 2010 2:06PM Telling a woman at the office she has a nice rack isn't, in and of itself, harassment. It's been said before; when Brad Pitt flirts it's welcome, when Pee-wee Herman does it, it's harassment.

Allow this variant: An educated women, for her own reasons, cultivates relationships of sexual ease in the workplace; bantering and playfulness. The norm of reciprocity prompts men to respond in kind. All is well. UNTIL, this educated woman doesn't get the promotion she wants or is finding herself stagnated in her position. She considers her options... Shut up and stay where she is, jump ship (in a bad economy) and hope for the best, or... get some leverage to use against her employer. What can she use? Well, big boobs always work well in most any situation and I'm sure they've worked for her in the past. So, she takes all those times men have made harmless and perhaps even welcomed comments about her breasts and uses those comments (though welcomed) as a weapon for her promotion. She starts dropping subtle hints (threats) and that's it for her career. They've already decided to can her for her treacherous and insubordinate behavior when she files her second sexual harassment complaint with HR. That's it, she's out.

Finding herself without employment in a bad economy, she files a lawsuit and once more looks to her big boobs to keep her afloat.:)

Nov 18th 2010 1:56PM Gman, how is it the Supreme court can't agree on what the forefathers intended, the tens of thousands of churches around the world can't agree on what God intended, but with all the wisdom of a man who takes a big titted woman for a wife, you know?

As for the lawsuit, I don't form opinions based on a TV interviews. The issue of her filing a harassment complaint before being fired may well be coincidence, not causation. It's at least conceivable she knew she was getting canned and wanted to plant the seed for a future lawsuit.

Aug 11th 2010 2:40AM Lies are a form of false signaling and as such are punished throughout the animal kingdom. We rely on signals from others to accept or reject them and protect our self interests. False signals from others are a form of attack which puts us in danger and damages us.

If a guy plies a woman with enough alcohol to make her comatose and has sex with her, he rapes her because he has sex without her consent. It follows that when a man creates a false identity (saying he's rich and famous) and the woman has sex with him based on those desired traits, she isn't consenting to have sex with the ex convict on welfare he turns out to be. This is a bit above the heads of some people but it's a dangerous situation for men to be in.

The reciprocal of this, as evidenced by women craving financial security the way men crave sex of course is that for every male rapist of that type, there's a female thief. Women routinely send false signals to men in attempts to receive financial benefit and comforts or relieve them of having to perform expected "services." Whether the benefit be diners, help with bills, help with rent, or just to make their lives easier or whether it's telling a guy she's on her period to avoid having sex it amounts to the same thing; a con game, a flimflam, a swindle, thief by deception.

People in love suffer from emotional overload and are unable to adequately protect their own self interests. People (male or female) who take advantage of others in that situation are creeps.
